Open source protocol generator: How can you choose the right legal protection for your code?

Include one when publishing open source items on GitHub or other platforms LICENSE (licence) Documentation is essential. The code without a licence is not a true “open source” in law - the law retains all rights by default, which means that others may not be able to use, modify or distribute your code legally. This tool is designed to help you quickly generate standard and valid protocol files.

1. Common open-source protocol comparison

  • MIT License: The simplest, most relaxed agreement. It allows people to do anything with your code, as long as they keep a copyright declaration. It applies to projects that wish to maximize dissemination.
  • Apache License 2.0: Similar to MIT, but with a clear patent mandate. Large-scale enterprise projects with large patents are the preferred option.
  • GNU GPLv3: Agreements with “transmissible” nature. If someone uses GPL in their project, code, then their projects must also be open and use GPL. It applies to projects that promote free software spirit.
  • BSD 3-Clause: Similar to MIT, but no one is explicitly prohibited from using your name for promotion.

2. How can you choose an agreement that suits you?

Seeking simplicity? Select MIT. It's the most popular protocol in GitHub, simple, user-friendly.

Concerned about patent risk? Select Apache 2.0. It provides better patent legal protection than MIT.

Hope the code is open for all time? Select GPLv3. It ensures that any derivatives based on your code must also remain open and prevent others from commercializing them.

Why do you have to include the LICENSE file?

Compliance: Many companies prohibit the use of third-party banks without clear licences.

Community collaboration: Clear licences remove legal concerns of potential contributors and help attract more people to your projects.

Immunity from liability: Standard agreements usually contain exoneration statements to protect authors from legal disputes arising from code defects.

4. How can the resulting agreements be used?

  1. Create a name under your root directory LICENSE or LICENSE.txt - The file.
  2. Click the Copy protocol contents button of this tool and paste the contents into the file.
  3. Submits this file to your version control system (e.g. Git).
  4. Add a "License" chapter to the bottom of README.md file and link it to the document.

Common issues (FAQ)

Q: Can I change the protocol after the project is released?
A: Technically, but it's very complicated. You usually need to obtain the consent of all previous contributors or apply the new protocol only to new versions. It is recommended that the selection be carefully made at the time of commencement of the project.

Do I need a lawyer to explain these agreements?
A: This tool generates standard open-source protocols. Although we are not legal professionals, these agreements have been widely accepted and supported by a large body of legal precedents in the open-source community.
