How much is it gonna cost to get a case? Detailed information on the rates of court fees in China

The first step in initiating legal proceedings is usually to be presented to the court. Case-processing fees 。 The amount of the costs directly affects the costs of defending the rights of the parties. According to 2007 The Cost-of-Terror Scheme, which has been in place since then, has a completely different costing logic for different types of cases.

1. Property cases: measures based on step scale

In cases involving property disputes such as money, property, equity, etc., the fee is calculated in “scrutinized segments”:

Less than $10,000: 50 dollars per piece.
From $10,000 to $100,000: The sum of over 10,000 is paid at 2.5%.
Between 100,000 and 200,000 yuan: The amount over 100,000 is paid at 2%.
From 200,000 to 500,000 dollars: The portion over 200,000 is paid at 1.5%.
The larger the target, the lower the percentage: The highest step (over $ 2000 million) is only 0.5%.

2. Non-property cases: billing on a case-by-case basis

In disputes not directly involving property, fixed fees are usually charged on a piece-by-piece basis:

Divorce cases: Between $50 and $300 per piece. If the property is divided, the sum of the sum of over $200,000 is to be added by 0.5 per cent.
Labour disputes: Ten dollars each. This is the very low threshold set by the State for the protection of workers ' rights.
Administrative cases: The administrative cases of intellectual property rights such as trademarks, patents and so forth amount to $100 per case and other administrative cases amount to $50 per case.

What circumstances “depreciated”?

The law provides for the reduction of the costs of litigation in half in certain cases to encourage efficient dispute resolution:

Summary procedure: Cases that are clear and minor are dealt with in summary proceedings are received in half.
Conclude mediation: Where a conciliation agreement is reached before or during the trial, the amount is usually collected in half.
Withdrawal of complaint: If the application for withdrawal is granted, the same applies for a refund of half of the fee.

4. Who will bear the costs of the proceedings?

In principle, “Who loses and who pays” 。 The plaintiff pre-paid the case and, upon completion of the case, the court will specify in its judgement the final party responsible for the costs. If the case is successful, the costs prepaid by the plaintiff will be returned by the defendant or by the court.
